1. Order Confirmation and Payment

The Customer definitively accepts their order upon payment. The order will not be considered valid or processed until the full price of the selected image has been paid.

At GroowPhoto, all payments are exclusively processed through the payment platform integrated into our website (Wix). We do not accept payments through any other method.

We reserve the right to reject orders from Customers who have not fully or partially paid for previous orders or with whom there is an ongoing dispute regarding non-payment.

Once payment has been successfully completed, GroowPhoto will send a confirmation email, which constitutes the final acceptance of the sales contract.


2. Intellectual Property

The Customer acknowledges that all images sold through GroowPhoto are protected by intellectual property rights. Purchasing a copy (whether digital or printed) does not grant any ownership rights over the work beyond the authorized personal use.

It is strictly prohibited to reproduce, distribute, modify, resell, or commercially exploit the images without the express written consent of the rights holder.

Any unauthorized use may result in legal action by the rights holder.


3. Handling and Use of Images

If purchasing physical copies, the Customer must handle and display them with care. It is recommended to:

• Avoid direct sunlight exposure.

• Not place them outdoors unless the material is specifically adapted for it.

• Not place them in humid environments (such as bathrooms or kitchens).
  
   

4. Image Description

Images available on GroowPhoto include a description provided by the artist or editorial team. We strive to ensure that descriptions are complete and accurate, although we are not responsible for minor visual differences due to screen or device settings.


5. Order Tracking and Delivery (if applicable)

For physical products, the Customer can track their order through the information provided via email.
Indicated production and delivery times are estimates and may be affected by external factors such as logistics delays, technical issues, or force majeure.


6. Claims

Damaged Package: If the order arrives visibly damaged, the Customer must notify us within 48 hours of receipt, attaching images of the package and the product. We will arrange a replacement or refund as applicable.

Incorrect or Non-Conforming Product: If the received product does not match the order (wrong image, format, or material), the Customer must contact us within 48 hours of receipt. We will assess the situation and provide an appropriate solution.


7. Right of Cancellation

The Customer has the right to withdraw from this contract without justification within 30 days from receipt of the product or the purchase of the digital file, provided that it has not been downloaded.

8. Duration and Termination of the Contract

The acceptance of these terms by the Customer establishes a legal relationship of indefinite duration. Both GroowPhoto and the Customer may terminate this relationship at any time. Orders already placed will remain valid until fulfilled.


9. Platform Availability

This website is available 24/7, except for maintenance or technical interruptions. GroowPhoto is not responsible for failures caused by third parties (such as internet service providers or the Wix platform).


10. Personal Data Protection

The data provided by the Customer is used exclusively for order management, customer service, communication, and legal compliance.

GroowPhoto does not sell or transfer this data to third parties without authorization, except for service providers involved in the delivery or billing process.

The Customer may exercise their rights to access, rectify, or delete their data by contacting groow@groow.es.


11. Cookies

By using our website, the Customer agrees to the use of cookies to enhance their browsing experience. The Customer may configure their browser to reject cookies, though this may affect some site functionalities.


12. Modification of Terms

GroowPhoto reserves the right to modify these Terms and Conditions at any time. The terms in effect at the time of order placement will apply.


13. Governing Law

These Terms and Conditions are governed by the applicable laws in GroowPhoto's country of residence (Spain, unless otherwise specified). Any disputes will be subject to the competent courts of the company's domicile.
